Judgment
This appeal is filed by one of the ‘Commercial Space Buyer’ in the MSX Mall. The appellant has challenged the order dated 03.04.2024 by which application filed by the RP bearing IA No. 1833/ND/2020, seeking approval of the plan submitted by the SRA has been allowed.
Counsel for the appellant has submitted that during the pendency of this appeal, a settlement has been arrived at with the SRA and in view of the settlement, the appellant does not want to continue with this appeal.
In view of the statement made by the appellant, the present appeal is therefore, dismissed as infructuous on the basis of the said settlement.
Counsel for the appellant has submitted that the probabilities of the settlement are very high but since the Director of the appellant is travelling out of India, therefore, no statement can be made at this stage. He seeks time to make the statement in this regard.
One last opportunity is granted.

This appeal is filed by as many as four appellants who are aggrieved against the order dated 03.04.2024 by which IA No. 1833/ND/2020 filed by the RP for approval of the Resolution Plan has been accepted.
The appellants are the Commercial Space Buyers in MSX Mall. During the pendency of this appeal, the parties have entered into a settlement out of court and an affidavit in this regard has also been filed by the Respondent.
Ld. Counsel for the appellant has submitted that in view of the settlement and the affidavit filed by the Respondent, the present appeal may be disposed of as having become infructuous. On this statement, the present appeal is hereby dismissed as infructuous on the basis of the alleged settlement.
