This is first bail application filed by the applicant/accused under Section 439 of the Cr.P.C. for grant of bail who is in custody since 25.03.2021 in
connection with Crime No.120/2021 registered at Police Station Omti, Jabalpur for the offences under Sections 323, 324, 327, 307/34 of IPC and
under Sections 25/27 of Arms Act.
It is alleged by the complainant that the applicant and co-accused committed marpeet with him. The applicant and co-accused made illegal demand of
money from the complainant. Further the applicant and co-accused inflicted injuries by means of knife and stick. On the basis of aforesaid, offence
has been registered against the applicant.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. He has not committed any offence. Charge
sheet has been filed. The applicant is in custody since 25.03.2021 and due to Covid-19 Pandemic, the trial would take considerable time to conclude.
The applicant is permanent resident of the District Jabalpur and there is no likelihood of absconding or tampering with the prosecution evidence by the
applicant. In view of the aforesaid, prayer is made to enlarge the applicant on regular bail.
Learned counsel for the State has opposed the bail application.
Heard learned counsel for both the parties and perused the entire material available in the file.
Looking to the aforesaid facts and circumstances of the case and the fact that present applicant is the main accused who caused stab injury to the
complainant, this court is not inclined to grant bail to the applicant. Accordingly, the application filed by the applicant under section 439 of the Cr.P.C.
is hereby dismissed.
