By means of this writ petition moved under Article 226 of Constitution of India, the Petitioner has sought quashing of the First Information Report dated 03.08.2011, registered as Crime No. 349 of 2011, relating to offences punishable u/s 332, 353, 504, 506 and 427 I.P.C., Police Station Kotwali Nagar Hardwar, District Hardwar.

Petitioner is said to have manhandled the police official on duty and torn his uniform. The plea of the Petitioner is that illegal demand was made by the Respondent No. 3 (police official), and the Petitioner did not oblige him.

Having considered submissions of learned Counsel for the parties, and after going through the papers on record, this Court is not inclined to interfere with the investigation of the case.

Therefore, without expressing any opinion as to final merits of the case, the writ petition is dismissed summarily, with the observation that if the Petitioner Rinku Sukhija surrenders before the court concerned, his bail application shall be heard and disposed of without unreasonable delay. (Stay Application No. 8752 of 2011 stands disposed of).
