Judgment
Avneesh Jhingan, J
The matter is taken up for hearing through video conference due to COVID-19 situation.
This is a petition for regular bail in FIR No. 52 dated 19.3.2020 under Section 21 of NDPS Act, 1985 registered at Police Station Sahnewal, District
Ludhiana.
On a secret information received the petitioner along with two other co-accused were apprehended and recovery of 100 grams of heroin was made
from the petitioner.
Learned counsel for the petitioner submits that the petitioner was arrested on 19.3.2020 and is in custody since then. The investigation is complete.
The challan has already been presented. It is submitted that recovery is of non-commercial quantity. He relies upon the order of this Court whereby
the co-accused have already been granted bail.
Learned State counsel has filed custody certificate dated 14.12.2020 and the same is taken on record. She opposes the bail submitting that there are
other FIR against the petitioner.
The petitioner is detained for 8 months and 20 days and in all other FIR mentioned in the custody certificate, either he underwent the sentence or has
been released.
Considering that the recovery is of non-commercial quantity and the co-accused was granted bail by this Court, the petitioner is granted bail subject to
his furnishing surety to the satisfaction of trial Court.
