Judgment
Arindam Lodh, J
Heard Mr. S. Lodh, learned counsel for the applicants. Also heard Mr. Raju Datta, learned PP appearing for the respondent-State.
On serious apprehension of arrest in connection with East Agartala Women PS case No. 041 of 2024 registered under Sections 85/103/3(5) of the BNS, 2023, the applicants had jointly approached this court by filing the instant application under Section 482 of BNSS, 2023, for enlarging them on pre-arrest bail.
As per the complaint, the daughter of the complainant was given into marriage with Sanjit Saha and after the marriage she was tortured by her husband as well as by her inlaws and on the alleged date of the incident, his daughter was severely beaten by the applicant-accused persons and the accused persons had killed her by forcibly administering poison into her mouth.
Mr. Lodh, learned counsel appearing for the applicant-accused persons has submitted that the accused persons are not involved with the alleged incident and they were falsely implicated with the alleged incident.
Learned PP has produced the case diary.
I have perused the case diary as well as the case record.
From the case diary, prima facie I do not find any material against the present applicant-accused persons as it is revealed that the victim prior to her death had volunteered before the Magistrate that she has consumed sleeping pills on her own. From the case record it is also revealed that two other accused persons were also enlarged on pre-arrest bail vide order dated 19.09.2024 passed by this court. In the instant case, the accused persons are parents-in-law and sister-in-law of the victim.
In the light of above, I am inclined to grant anticipatory bail to the applicant-accused persons.
Accordingly, in the event of arrest, the applicants, namely, Smt. Rina Saha, Sri Nagendra Chandra Saha and Smt. Fulan Saha may be released on bail on furnishing a bond of Rs.25,000/- each with one surety of the like amount to the satisfaction of the arresting authority.
With the above observations and directions, the instant application stands allowed and thus disposed.
