MATA no.305 of 2023 and I.A. no.453 of 2023
Ms. Sinha, learned advocate appears on behalf of applicant/appellant-wife. She submits, her client has preferred appeal against judgment dated 14th March, 2023 made by the family Court. Her client is aggrieved by the order of maintenance.
She submits further, respondent-husband has also filed appeal against same judgment. The appeal stands admitted. In the circumstances, the delay be condoned and this appeal also be admitted.
Ms. Bastia, learned advocate appears and submits, she is representing respondent-husband in his appeal (MATA no.127 of 2023). She undertakes to file her power. Ms. Sinha make serves the appeal papers along with the application for condonation of delay to Ms. Bastia, who prays for time for her client to file objection.
Considering that respondent-husband has his appeal admitted against same impugned judgment, we are not inclined to give direction for filing objection. Perused causes shown. We accept them. Ms. Bastia submits, there be direction for payment of cost.
The delay is condoned and the appeal admitted. We are not inclined to direct cost on appellant-wife, who is claiming higher maintenance from respondent-husband.
The appeal is admitted and the application disposed of.
Ms. Bastia waives formal notice of appeal.
