1 In the present writ petition, the petitioner has challenged the order dated 28.04.2017 (Annexure P-6) passed by respondent No.4 vide which, the claim of the petitioner for grant of family pension/pensionary benefits of his deceased-father, namely, Sukhdev Singh has been declined.
Learned counsel appearing on behalf of the petitioner, on instructions from the petitioner, submits that the petitioner will be satisfied, if at this stage, a direction is given to respondent No.4 to re-consider the case for grant of family pension and to decide the same in a time bound manner.
Learned counsel appearing on behalf of the respondents-State does not oppose the prayer made by the learned counsel appearing on behalf of the petitioner.
Learned counsel appearing on behalf of respondents No.6 and 7 submits that during the pendency of the present writ petition, respondents No.6 and 7 have also attained majority.
In view of above and without commenting upon the merits of the case, the present writ petition is disposed of with a direction to respondent No.4 to re-consider the case of the petitioner, for grant of family pension, and decide the same in accordance with law/rules, within a period of 02 months, from the date of receipt of certified copy of this order. In case, the petitioner is held entitled for grant of family pension, as per law/rules, the same be granted to him, within a period of 01 month, thereafter.
Pending miscellaneous application(s), if any, also stands disposed of.
