Judgment
The present petition has been filed under Section 482 Cr.P.C. praying that newly married couple be granted protection as they apprehend danger to their life at the hands of those who have not accepted the marriage.
Smt. Richa Pareedwal petitioner no.1 is present in the court alongwith petitioner no.2 Ashok Kumar Pareedwal. They have been identified by their counsel Mr. Govind Gupta. She has stated that she was born on 25.10.1998 and she is student of B.A. Final Year.
Mr. Vinay Jain respondent no.4 father of the petitioner no.1 is also present in the court alongwith his wife and mother. Mr. Vinay Jain has been identified by his counsel Mr. Atul Jain.
On the request made by the learned counsel for the respondent no.4, petitioner no.1 Smt. Richa Pareedwal was asked to have interaction with her father, mother and grandmother. After having meeting with her relations, she has stated in categoric terms that since she is more than 18 years of age, she has performed marriage with the petitioner no.2 Ashok Kumar Pareedwal as per her own accord and will, therefore, she intend to stay with her husband petitioner no.2.
Mr. Vinay Jain, respondent no.4 has stated that he shall keep no relations with his daughter and he will not interfere in her married life.
There is constitutional guarantee in favour of the petitioner to stay and reside wherever she so wishes. Hence, the present petition is disposed of with the direction to the respondent no.3 Station House Officer, Police Station Niwai, Tonk to ensure necessary vigil that no harm is caused to the life and liberty of the petitioners.
A further direction is issued to SHO, Police Station Ashok Nagar, Jaipur to make an entry in Daily Diary Register regarding the orders received from this Court and he/she shall also ensure that a police personnel is sent with newly married couple to the place of residence of petitioners. The police personnel shall also inform the respondent no.3 SHO, Niwai, Tonk regarding the orders passed by this Court.
Mr. Atul Jain, counsel for the respondent no.4 who has identified respondent no.4 in this Court stated that the respondent no.4 is adamant and he is not willing to put his signatures so that he can identify them.
Petitioner no.1 who is present in the court alongwith her husband, has expressed apprehension that they shall be physically harmed by the respondent no.4 and his relations.
From the conduct of the respondent no.4, this Court can safely infer that there is imminent threat to life of the petitioners and there is also apprehension of breach of peace. Therefore, SHO Niwai, Tonk, is directed to hold security proceedings under Sections 107 and 151 Cr.P.C. against the respondent no.4 and his relations so that no harm is caused to the newly married couple.
