Judgment
Rajiv Sahai Endlaw, J.—The counsel for the Petitioner states that the copy of the counter affidavit of the Respondent No. 2 has been received today only. He seeks time to rejoin.
This petition has been filed to restrain the Respondents from dealing with the unauthorized colony of Chotiyal, Palam Village, Delhi to which Provisional Regularization Certificate is stated to have been issued, otherwise in accordance with law.
The Respondents have framed the Regulations for Regularization of Unauthorized Conies in Delhi, 2008 in pursuance of the judgment of the Division Bench of this Court in W.P.(C) No. 4771/1993 titled Common Cause (Regd.) v. UOI qua unauthorized colonies in Delhi.
The Respondents are required to deal with the said unauthorized colony as per the said Regulations. The petition is disposed of with a direction that the said colony shall also be dealt with in accordance with the said Regulations and only such actions as are permitted in the Regulations shall be taken shall be taken with respect to the said colony.
No order as to costs.
