Thomas P. Joseph, J.—Petitioner is the de facto complainant in C.C. No. 356 of 2010 of the court of learned Judicial First Class Magistrate-I, Trichur and wife of the 2nd Respondent. On her complaint, learned Magistrate directed the Viyyur police to register a case and accordingly the police registered Crime No. 88 of 2010 for offences punishable under Sections 406, 420 and 498A read with Section 34 of the Indian Penal Code (for short, "the IPC"). The police after investigation submitted final report for offence u/s 498A read with Section 34 of the IPC. Petitioner states that she has settled the dispute with Respondents 2 to 5. Parties have filed joint petition dated 19-03-2011 which is signed by counsel as well. It is revealed that the dispute is between Petitioner and Respondents 2 to 5. Since the dispute is personal to and between Petitioner and Respondents 2 to 5 and that dispute is settled, it is not necessary to continue proceeding against Respondents 2 to 5.

Resultantly this Crl.M.C. is allowed. Final report in Crime No. 88 of 2010 of Viyyur Police Station, cognizance taken thereon and proceeding against Respondents 2 to 5 in C.C. No. 356 of 2010 of the court of learned Judicial First Class Magistrate-I, Trichur are quashed.
