Manoj Kumar Tiwari, J
Registrar, Cooperative Societies, Uttarakhand passed an order on 02.03.2021 against the petitioner Cooperative Society, superseding its Committee
of Management. According to the petitioner, a Statutory Appeal under Section 98 of Uttarakhand Co-Operative Societies Act, 2003 alongwith stay
application has been filed before the State Cooperative Tribunal at Dehradun against the said order.
It is the contention of learned counsel for the petitioner that quorum of the State Cooperative Tribunal is not complete, consequently, petitioner’s
Appeal as well as stay application is not being considered.
Learned Brief Holder was asked to get instructions in the matter. Today, on instructions, learned Brief Holder makes a statement that one Member
of the Cooperative Society has been appointed by the State Government on 31.07.2021. Thus, according to him, the quorum of State Cooperative
Tribunal is complete. He further submits that now one Chairman and two Members are available for disposal of judicial work.
Having regard to the statement made by learned Brief Holder, the writ petition is disposed of with a request to State Cooperative Tribunal at
Dehradun to consider petitioner’s stay application filed alongwith his Appeal on the next date fixed i.e. on 7.09.2021 or on any other day within
three weeks thereafter.
