Judgment

For the reasons recorded in the application, the same is allowed.
Compromise dated 28.05.2019 (Annexure P-9) is taken on record.

1 The parties have amicably settled their dispute in terms of compromise dated 28.05.2019 (Annexure P-9). The aforesaid fact stands verified by the Naib Tehsildar-cum-Assistant Collector 1st Grade, Phillaur, District Jalandhar who filed reply by way of affidavit and submitted as under :-
“3 That it is submitted that the deponent in compliance with the above order dated 05.09.2019 made verification of the facts stated in the said compromise dated 28.05.2019 (P/9) between Sh Resham Singh s/o Gurbachan Singh s/o Kartar Singh resident of village Khehra, tehsil Phillaur district Jalandhar, Ist Party with Sh Shingara Ram s/o Sh Sarwan Ram s/o Lakha Ram as well as Smt Balvir Kaur w/o Shingara Ram s/o Sarwan Ram, residents of village Khehra, tehsil Phillaur, 2nd Party and got their statements recorded. The statement of all the witnesses shown in the above compromise dated 28.05.2019 namely S/Sh Harbans Lal, Sarpanch, Amandeep, Panch and Sukhjinder Singh, Panch as well as Kashmir Singh, who is son of Resham Singh, petitioner has also been recorded on 18.10.2019.
4.That in this regard it is submitted that according to the statement of Sh Resham Singh s/o Gurbachan Singh, Ist party, he has made written agreement with Shingara Ram son of Sarwan Ram s/o Lakha Ram and Balvir Kaur w/o Shingara Ram s/o Sarwan Ram, residents of village Khehra on 28.5.2019 in the presence of respectable and members of Panchayat on a stamp paper of Rs.100/-bearing No: AB 180353 regarding the dispute in the partition of land, in which he has put his thumb impression, whereas the second party has made signatures without any pressure. He has seen its copy which contains his thumb impression and signatures of second party Shingara Ram, his wife Balvir Kaur and the signatures of witnesses namely Amandeep (Panch), Sukhjinder Singh (Panch) and Harbans Lal Sarpanch and Kashmir Singh s/o Resham Singh. He has no objection to the conditions described in this compromise deed and agreed to all the conditions of this agreement deed. He has further certified that this agreement has been made by him in his full senses and without any pressure. A copy of statement of Resham Singh is attached as "Annexure R/1'.
2 In view of above, the present writ petition is disposed off in terms of the compromise. The revenue authorities shall take cognizance of the compromise and mutate the partition accordingly.
3 Petition stands disposed off.
4 The compromise shall be in supersession of the orders passed by the authority below.
5 Pending miscellaneous application, if any, also stands disposed off.
