Judgment
Alok Singh, J.—Present petition is filed challenging the order dated 07.08.2010 passed by learned Civil Judge (Senior Division), Moga, thereby declining the request of the Plaintiff-Petitioner to extend time to deposit balance sale consideration pursuant to the decree for specific performance.
This Court vide order dated 27.09.2010 directed to issue notices to the Respondents. Respondents are stated to be served vide report of the Registry, however, none is present on behalf of the Respondents, hence, petition is being heard.
From the impugned order, it reveals that no application for rescinding/rescission of the contract has been moved so far by the Defendants. In view of this, this Court finds that time to deposit balance sale consideration ought to have been extended.
In the peculiar facts and circumstances of the case, Plaintiff-Petitioner is directed to deposit sale consideration within 15 days from today. However, it is made clear that no further time shall be extended. If such deposit is made, learned Executing Court shall proceed in accordance with law.
Petition stand disposed of accordingly.
