Judgment

Petitioner who is accused No.1 is seeking to be enlarged on bail in Crime No.377/2022 for the offences punishable under Sections 323, 324, 448, 307, 506 read with Section 34 of IPC.
Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the State.
Perusal of the complaint indicates that there is no specific allegation that accused No.1 has assaulted the victim on his forehead with the beer bottle, and the allegation is that one among the three accused has hit the victim on his forehead. Whether the petitioner has assaulted the victim on his forehead with the beer bottle is a matter, which requires to be investigated. At this stage, petitioner has made out a prima facie case to enlarge him on bail.
Accordingly, I pass the following:
ORDER
Criminal petition is allowed. Petitioner-accused No.1 is enlarged on bail in Crime No.377/2022 registered by Mahadevapura Police Station for the offences punishable under Sections 323, 324, 448, 307, 506 read with Section 34 of IPC, subject to the following conditions:
(a) Petitioner/accused 1 shall furnish a personal bond for a sum of Rs.1 lakh with one surety for the likesum to the satisfaction of the jurisdictional Court.
(b) He shall appear before the Court as and when required.
(c) He shall not threaten or allure the prosecution witnesses in whatsoever manner.
(d) He shall not get involved in similar offences.
(e) He shall not leave the territorial limits of the Trial Court without prior permission of the Trial Court.
(f) The petitioner/accused 1 shall be physically present and mark his attendance before the Station House Officer, Mahadevapura Police Station, on every tenth day of the month at 11.00 a.m., till filing of the charge sheet, if any.
