Judgment
Satyen Vaidya, J
Since, the petitioner has already completed her normal tenure at ESI Hospital, Darlaghat, District Solan, no ground for interference is made out.
It is, however, urged on behalf of petitioner that her transfer during mid academic session shall seriously prejudice the education/studies of her son, who is presently in Plus Two. It has also been submitted that one post is lying vacant at Civil Hospital, Arki, where the petitioner can be adjusted and if she is adjusted in the aforesaid manner, she will be able to manage her household affairs and education/studies of her son shall also not be disturbed.
Keeping in view the aforesaid peculiar circumstances, petitioner is permitted to submit a representation to respondent No.2 within three days from today and on receipt of such representation, respondent No.2 shall consider and decide the same sympathetically keeping in view the peculiar circumstances involved in the case within a period of one week thereafter. It is made clear that till the final decision on the representation of the petitioner, she shall not be compelled to join at the place where she has been transferred. In case, the petitioner does not submit her representation within three days, this order shall seize to have effect.
