Judgment
Jaswant Singh, J.—Present petition u/s 482 CrPC was filed by the petitioners alleging therein that they both being major and in love with each other performed inter caste marriage on 10.4.2010 against the wishes of parents (respondents 4 and 5) of petitioner No. 1-wife, due to which they apprehend danger to their life and liberty. Accordingly, prayer was made to direct the official respondents (police authorities) to save their life and liberty at the hands of aforesaid respondents.
Vide order dated 6.5.2010, notice of motion was issued to respondents and in the meantime SP Jind was directed to ensure the protection of the petitioners.
In pursuance to the notice of motion, Sh. Satheesh Balan, SP Jind has filed reply on behalf of respondents 1 to 3, the relevant extract (para 3) of which is reproduced hereunder:
That the brief facts pertaining to this case are that on receipt of copy of order dated 6.5.2010, referred above, the matter was got inquired through Station House Officer, Police Station, Julana. As per report of ASI Om Parkash of Police Station, Julana both the petitioners are major and had solemnized marriage with each other, as per their sweet will. During inquiry statement of parents of petitioner No. 1 Reenu was recorded by which they have stated that there is no apprehension of breach of peace or danger to the lives and liberty of the petitioners. It is further submitted that on 24.4.2010 both the petitioners were also produced before the Sub Divisional Magistrate, Jind and they deposed that no police protection is required to them. The petitioners were handed over to their friend Sunil Raj s/o Ranjit, Bhagat Singh Colony, Jind. In this regard DDR No. 24 dated 24.4.2010 at 3.00 pm was also recorded in the roznamcha of Police Station, Julana. However, the life and liberty of the petitioners shall be protected as per law.
No one has come present on behalf of the petitioners to deny the aforesaid stand taken by the respondent State.
In view of the above, no further action is called for in the instant petition.
Disposed of accordingly.
