Hon'ble Shri Justice Amitendra Kishore Prasad

1.

The petitioners, in this Writ Petition, have prayed for the following reliefs:-

“a)

Issue an appropriate writ, order or direction directing Respondent No. 3 Collector, Surguja, to decide the Petitioners application dated 16.03.2022 for grant of permission to sell 7.5 decimal rehabilitation land out of Khasra No. 267/7, village Subhashnagar, under Section 165(7-B) of the Chhattisgarh Land Revenue Code, which is pending since more than four years, within a stipulated time frame, preferably within an outer limit of 15 days from the date of receipt of a certified copy of the order of this Hon'ble Court.

b)

Award the cost of this petition to the petitioners.

c)

Pass any other order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.”

2.

Learned counsel for the petitioners submits that the petitioners have filed an application dated 16.03.2022 before the concerned Collector seeking permission to sell a portion of their land under Section 165(7-B) of the Chhattisgarh Land Revenue Code, 1959. He submits that the petitioners are facing financial hardship due to the medical treatment of the husband of petitioner No. 1 and father of petitioners No. 2 and 3, who has since passed away. He further submits that the petitioners have incurred loans from various persons and seek to sell a small portion of their land, admeasuring 0.030 hectare out of the total land admeasuring 0.540 hectare, to repay the said loans. However, despite the application having been filed way back on 16.03.2022, the same has not yet been decided. Therefore, the petitioners have approached this Court seeking appropriate relief.

3.

Learned State counsel submits that, considering the long pendency of the application and the fact that a fresh report was called for on 07.10.2024, he has obtained instructions from the concerned Collector over the telephone. He further submits that the concerned Collector has assured that the application shall be decided within 15 days.

4.

Considering the submissions made by learned counsel for the parties and the facts and circumstances of the case, the concerned Collector is directed to consider and decide the petitioners’ pending application in accordance with law within a period of 15 days.

5.

With the aforesaid observations and directions, the present petition stands disposed of.
