Heard Mr. Subrata Sarkar, learned senior counsel assisted by Ms. V. Poddar, learned counsel appearing for the applicant. Also heard Mr. S. Ghosh, learned Addl. P.P appearing for the State-respondent.

This is a bail application filed by the wife of the accused under Section 439 of Cr.P.C. to release the accused on bail who has been in custody for more than 39 days in connection with Bishalgarh PS Case No.2024/BLG/013 registered under sections 457/380/401 of IPC.

Mr. Sarkar, learned senior counsel for the applicant has submitted that the accused-Amal Hossain is innocent day labourer and he has no connection with the alleged theft in the FIR.

Considering the fact that the offences as alleged in the FIR prescribed maximum punishment of 7(seven) years and that the investigation has already been completed, I am inclined to release the accused on bail.

Accordingly, the accused, namely, Amal Hossain is released on bail on furnishing a bail bond of Rs.25,000/- (Rupees twenty five thousand) with one surety of like amount to the satisfaction of learned SDJM, Bishalgarh, Sepahijala Tripura, provided that the accused shall abide by the following conditions:

I. The accused shall appear before the Officer-In-Charge/Investigating Officer, Bishalgarh Police Station 5(five) days a week.

II. The accused shall not go outside territorial jurisdiction of the Bishalgarh Sub-division without prior permission of the Investigating Officer.

Resultantly, the bail application is allowed subject to the aforesaid conditions.

Liberty is granted to the accused to approach the concerned jurisdictional Court with a prayer for relaxation of the bail conditions.
