Since these four bail applications arise out of one and same case record, the same are heard together and disposed of by this common judgment with the consent of the learned counsel for the parties.

These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Maitri Vihar PS Case No.107 of 2025 corresponding to TR Case No.139 of 2025 pending in the file of learned Additional District and Sessions Judge-Cum-Special Judge (CBI-II), Bhubaneswar, for commission of offences punishable U/S.21(c) of NDPS Act, on the main allegation of possessing 256Grams of Brown Sugar, along with co-accused person.

Heard, Mr. Bijay Kumar Behera, learned counsel for the petitioners and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record together with copy of depositions of PWs.1 to 11 as produced.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the allegation sought to be brought against them and regard being had to the recovery of 256Grams of Brown Sugar, which is more than the commercial quantity from the dash board of the Car allegedly in occupation of the petitioners and their consequent failure to satisfy the conditions of Section 37 of NDPS Act, which is sine qua non for grant of bail to an accused for commission of an offence under NDPS Act involving commercial quantity and trial being likely to be concluded in near future, since 11 witnesses have already been examined and lastly, the non-disclosure of the antecedent by the petitioner Reka @ Rekka Pattnaik in BLAPL No.4296 of 2026 on the face of the law laid down by the Apex Court in Munnesh Vrs. State of Uttar Pradesh; 2025 SCC OnLine SC 1319, this Court does not consider it proper to grant bail to any of the petitioners.

Hence, these four bail applications of the petitioners namely Reka @ Rekka Pattnaik (In BLAPL No.4296 of 2026); Tinku Mahanta @ Tinku Mahnto (In BLAPL No.4327 of 2026); Muna Sethi (In BLAPL No.4332 of 2026) and Subrat Rout (In BLAPL No.4338 of 2026) stand rejected. Accordingly, these BLAPLs stand disposed of.

In view of the alternative oral prayer as advanced for the petitioners, trial be expedited, if there is no other legal impediment. A copy of this order be immediately transmitted to the learned trial Court for reference.
