Petitioner is the first accused in Crime No.80/2023 of Kodanadu Police Station, alleging commission of offences under Sections 143, 147, 447, 294(b), 341, 323, 506, 149 of the Indian Penal Code.
The learned counsel appearing for the petitioner would submit that all disputes between the petitioner and the 2nd respondent, at whose instance the crime was registered, have been settled in mediation, as is evident from Annexure-A2, which is the terms of settlement in Tr.P.C No.255/2023 on the file of this Court. It is submitted that Annexure-A2 also contains a clause regarding the settlement of all disputes in Crime No.80/2023 of Kodanadu Police Station.
Heard the learned Public Prosecutor also.
Having heard the learned counsel for the petitioner and the learned Public Prosecutor and having regard to the terms of Annexure-A2 settlement, I am of the view that all proceedings against the petitioner in Crime No.80/2023 of Kodanadu Police Station can be quashed in exercise of jurisdiction vested in this Court under Section 482 of the Code of Criminal Procedure.
Accordingly, this Crl.MC is allowed and all further proceedings in Crime No.80/2023 of Kodanadu Police Station, will stand quashed as against the petitioner on the ground of settlement.
