Judgment
This is an application filed u/s 438 of Code of Criminal Procedure seeking pre-arrest bail.
The petitioners are the accused in Crime No201 of 2021 of Ollur Police Station. The offences alleged are under Sections 362 and 395 of Indian
Penal Code, 1860.
The reason highlighted by the petitioners for approaching this Court with this petition is that they were served with Annexure 2 and 3 notices
respectively, issued under Sec.160 of Cr.P.C., requiring their appearance before the police officer on 13.04.2021.
The learned Public Prosecutor, upon instructions, submitted that the petitioners herein are not implicated in this crime. On the other hand, the
husband of the 1st petitioner is one of the accused in the said case and it is to enquire the whereabouts of the said person, the said notices were
issued. Since, it is reported that the petitioners are not arrayed as accused persons in the above crime till now, this bail application is closed. In case,
the presence of the petitioners are required, the same can be secured by the Investigating Officer by issuing notice under Sec.41A of Cr.P.C.
This bail application is closed as above.
