This contempt petition has been filed alleging wilful disobedience of the order dated 28.03.2018 in Writ Petition (M/S) No. 2098 of 2017. By the said order, the Competent Authority was directed to take decision on petitioner's claim for benefit under the scheme meant for dependents of deceased registered workers.
It is contended on behalf of the petitioner that despite direction issued by Writ Court, no decision in the matter has been taken by the Competent Authority.
Before initiating proceedings for contempt, this Court thinks that one opportunity may be given to the Competent Authority to comply with the order passed by Writ Court.
Accordingly, contempt petition is disposed of with liberty to the petitioner to make fresh application to the Competent Authority for benefit as was claimed by her in the writ petition. If petitioner makes such application within two weeks from today, the Competent Authority shall consider petitioner's application, in terms of the direction issued by Writ Court, within eight weeks.
