Nobody had appeared for the appellant on 6.1.2022, 21.12.2021, 17.12.2021, 10.12.2021, 25.11.2021 and this case is being adjourned continuously.

This appeal under Section 14-A(1) of the Scheduled Castes Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short ""SC/ST (P.A) Act"") is

taken up for consideration with the help of learned Panel Lawyer for the respondent No.1/State.

Trial Court has framed charges under Section 326 of the Indian Penal Code, 1860 (for short ""I.P.C"") and Section 3(2)(v) of SC/ST (P.A) Act in

connection with Crime No.249/2018 registered at Police Station Ajaygarh, District Panna. The charges were framed on 4.3.2021 and this appeal has

been filed on 16.3.2021 seeking quashing of the changed & altered charges.

The charges against the appellant are that appellant had caused grievous injury to Gautam Kori by biting his lower lip causing permanent disfigurement

consisting of an offence under Section 326 of the I.P.C. Similarly, it is alleged that though Gauram Kori is a member of Scheduled Caste Community

and appellant is not, but knowing this fact that the victim is a member of Scheduled Caste Community committed an offence, which is punishable with

10 years imprisonment or more under Section 3(2)(v) of SC/ST (P.A) Act.

After perusal of the charges, it is evident that it is a matter of evidence whether the aforesaid charges are proved or not but for the present, there are

no grounds to quash the charge sheet.

Later on, Shri Basant Pandey, learned counsel for appellant appears and after arguing at length & unable to convince this Court prays for withdrawal

of this bail appeal.

Accordingly, this appeal is dismissed as withdrawn.
