T his petition under Section 482 of Cr.P.C. has been filed by the petitioner for modification/correction of crime no.107/2022 in order dated 11/04/2023 passed in M.Cr.C. No.12038 /2023.
Counsel for the petitioner has submitted that due to mistake on his part, in the aforesaid order dated 11/04/2023, the crime number has wrongly been mentioned as Crime No.107/2022 instead of Crime No. 170/2023. Thus, it is submitted that the order be modified to the extent and the crime no.107/2022 be replaced to crime no.170/2023 in order dated 11/04/2023 passed in M.Cr.C. No.12038 /2023.
Prayer appears to be reasonable.
On perusal of the order dated 11/04/2023 and the record, this Court finds that the said mistake appears to be on part of the counsel which is required to be modified/corrected.
I n view of the same, it is directed that in the order dated 11/04/2023 passed in M.Cr.C. No.12038 /2023 is modified accordingly and the crime no. 107/2022 Âshall be read as Crime No. 170/2023.Other conditions of the aforesaid order shall remain as it is.
This order be read conjointly with order dated 11/04/2023 passed in M.Cr.C. No.12038 /2023. Copy of this order be placed in MCRC.No.12038/2023.
Accordingly, the petition is allowed.
