Judgment
The petitioner is seeking anticipatory bail in FIR No.504
dated 06.09.2017 under Sections 13-D, 125-A of Representation of
People Act, Section 199 / 420 IPC registered at Police Station
Mohindergarh.
Learned counsel for the petitioner contends that
allegations against the petitioner in the FIR are that at the time of
filing nomination papers for the election of Municipal Councilor, she
had allegedly concealed the factum of agreement to sell for the
purchase of property (Annexure P-4). He further contends that on
the date of nomination as well as election, only agreement to sell
had been entered with the seller of the land and the sale deed for a
part of the property was registered after five months of the election.
This Court, by the order dated 15.09.2017, had directed
the petitioner to appear before the Investigating Officer and join the
investigation and in the event of her arrest, she was to be released
on ad-interim bail to the satisfaction of the Investigating/Arresting
Officer, subject to the conditions envisaged under Section 438(2)
Cr.P.C.
Learned State counsel, upon instructions from ASI
Yashwant Singh, states that the petitioner has joined investigation
and is not required for custodial interrogation.
In view of the submissions of learned counsel for the
petitioner and keeping in view the fact that the petitioner has joined
investigation, the order dated 15.09.2017 granting interim bail to
the petitioner is made absolute.
However, the petitioner shall abide by the conditions
stipulated under Section 438(2) Cr.P.C. She shall also join
investigation as and when called upon to do so.
The petition stands disposed of.
