Judgment

This order will dispose of two transfer applications No. 44 of 2008 and 45 of 2008.
These are two applications u/s 24 CPC for transfer of petitions titled as ''Bittu v. Reena'' and ''Bharat Bhushan v. Sapna'' filed u/s 13 of the Hindu Marriage Act 1955, pending in the Court of Additional District Judge, Ferozepur to a Court of competent jurisdiction at Jalandhar.
It is the case of the applicants that they are married to the respondents in their respective petitions who are brothers. It is further stated that their marriage did not work out as a result of which divorce petitions u/s 13 of the Hindu Marriage Act have been filed by their respective husbands in the Courts at Ferozepur. It is also contended by the learned Counsel for the applicants that their father has since expired and it is extremely difficult for them to travel to Ferozepur to attend to the Court proceedings.
The aforesaid contentions and averments have gone uncontroverted as no reply has been filed.
After having heard learned Counsel for the parties and also keeping in view the observations of Hon''ble Apex Court in case titled as Sumita Singh Vs. Kumar Sanjay and Another, , I am of the considered opinion that the present applications deserve to succeed. Accordingly, the proceedings in the petitions titled as ''Bittu v. Reena'' and ''Bharat Bhushan v. Sapna'' filed u/s 13 of the Hindu Marriage Act 1955, pending in the Court of Additional District Judge, Ferozepur are transferred to a Court of competent jurisdiction at Jalandhar.
The Court at Jalandhar shall issue notice to the parties for appearance after receipt of the cases on transfer
