Judgment
IN the complaint filed by respondents/complainants it is stated that they had placed orders on petitioner/opposite party for installation of 200x2 LPD Tata Bp Solar Water Heaters on 13.1.1999 and 22.1.1999. Cost of both these was Rs. 24,500/- each. However, solar water heaters which were installed by the petitioner were of different make. After considering parties evidence, petitioner was directed to replace the water heaters of Tata Bp make failing which he was to pay Rs. 49,000/- being the costs thereof by the order dated 2.2.2001 by the District Forum. Appeal filed by the petitioner against this order was dismissed by the State Commission by the order dated 1.1.2003. IN view of concurrent findings recorded by District Forum as also State Commission that the two water heaters installed by the petitioner were of a make different form for which the orders were placed, we do not find it a fit case to exercise our jurisdiction under Section 21(b) of the Consumer Protection Act, 1986. Dismissed. Revision Petition dismissed.
