This is first bail application filed under Section 439 of Cr.P.C. on behalf o f applicants, who are in jail since 27.07.2022 in connection with Crime No.624/2022, registered at Police Station-Kotwali District- Sidhi (M.P.), for the offences punishable under Sections 8 & 20-B of NDPS Act and 34(2) of Excise Act.

Counsel appearing for applicants submitted that he does not want to press this application so far as Applicant No.1-Ravishankar Saket @ Golu is concerned.

Govt. Advocate appearing for State has made submissions that Applicant No.1 is absconding from law and number of criminal cases are registered against him.

In view of same, Application so far as it relates to Applicant No.1-Ravishankar Saket @ Golu is dismissed as withdrawn.

Counsel appearing for the applicant submitted that applicant no.2-Aakash Saket is young boy of 19 years and he is working in Kirana shop to earn his livelihood. He has no connection with crime. He has been implicated in the case as his brother is absconding from law. In these circumstances, prayer is made to enlarge applicant on bail.

Govt. Advocate appearing for State opposed the application for grant of bail and it is submitted that applicant is also involved in offence, therefore, bail may not be granted to applicant No.2.

Heard learned counsel for parties.

Considering the nature of allegations made against the applicant and co-accused Nirmala Saket, bail application filed by applicant is allowed. It is directed that the applicant No.2 - Aakash Saket be released on bail on his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount to the satisfaction of the trial court.

In addition to aforesaid condition, the applicant shall abide by the conditions enumerated under Section 437(3) of Cr.P.C.
