Judgment
The present writ petition has been filed challenging the technical evaluation summary dated 24.08.2026 issued by respondent no.3, whereby the technical bid of the petitioner was proposed to be rejected as well as the financial evaluation summary dated 05.09.2026 recommending acceptance of financial bid of the private respondent.
The principal contention of learned counsel for the petitioner is that the petitioner made complaint against the rejection of his bid in the technical round but without deciding the same, the respondents have proceeded to open the financial bids.
Learned counsel for the department has placed on record the decision of Tender Technical Committee, whereby the complaints submitted by the bidders including the one made by the petitioner have been decided. It is accordingly submitted that the contention that the complaint filed by the petitioner has not been decided is incorrect.
Learned counsel for the petitioner states that the respondents have not uploaded the decision taken by the Tender Evaluation Committee on the complaints on the portal.
Having regard to the same, we hereby direct that a copy of the decision taken by the Technical Evaluation Committee on the complaints of the bidders be provided to the petitioner during course of the day.
In view of the above, the present writ petition is disposed of with liberty to the petitioner to challenge the decision rejecting his complaint along with other reliefs as may be advised in independent proceedings.
Pending application(s), if any, stand disposed of accordingly.
