Harsimran Singh Sethi, J

Present petition has been filed by the petitioner challenging the order dated 17.08.2020 (Annexure P-4) as well as the order dated 09.09.2020

(Annexure P-5) by which, the petitioner has been de-registered from the Ph.d programme w.e.f. 31.08.2020.

Learned counsel for the petitioner submits that though, it is a matter of fact that the petitioner has not been able to clear the comprehensive

examination within maximum period of 18 months as required under law but the said non-clearance is due to certain facts and circumstances, which

were beyond the control of the petitioner hence, the petitioner is entitled for being given one more chance to clear the comprehensive examination as

the petitioner fulfills all the other required parameters for appearing in the comprehensive examination.

Learned counsel for the petitioner further submits that for the said request, the petitioner has already approached the authorities by filing a

representation on 30.09.2020 (Annexure P-7) and the said representation is still pending consideration with the respondents and the petitioner will be

satisfied at this stage, in case a time bound direction is issued to the respondents to decide the said representation by passing an appropriate speaking

order.

Notice of motion.

Mr. Amarjit Singh Virk, Advocate, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition,

accepts notice on behalf of the respondents and raises no objection for deciding the representation of the petitioner in a time bound manner by passing

an appropriate speaking order.

Without commenting upon the merits of the case or about the entitlement of the petitioner for the relief which has been claimed by him in the

representation dated 30.09.2020 (Annexure P-7), the present writ petition is disposed of with a direction to the respondents to decide the

representation dated 30.09.2020 (Annexure P-7) within a period of four weeks from the receipt of copy of this order.
