Ravinder Thakur and Others vs Durga Singh and Others

Kurian Joseph, C.J.—Writ Petition has been filed with the following prayers:

i) That the writ in the nature of mandamus may kindly be issued directing the Respondent No. 11 to provide the police assistance to the Petitioners to implement the order dated 24.7.2008 passed by the Ld. Civil Judge, (Junior Division), Kasauli and further directing the Ld. Civil Judge, (Senior Division), Kasauli to take up the matter till the Ld. Civil Judge, (Junior Division), Kasauli assumes the office for which the Petitioner humbly prays. ii) That the directing for future may also be issued to the Ld. Presiding Officers to take up the matters in case there is an urgency for which the Petitioners humbly pray.

Registrar informs that the Civil Judge (Jr. Division.) Kasauli is on maternity leave and orders had already been issued directing Civil Judge (Sr. Division) to attend to urgent matters falling within the jurisdiction of Civil Judge (Junior Division), Kasauli as well. Therefore, there will be a direction to the Civil Judge (Sr. Division), Kasauli to take up for consideration the applications of urgent nature filed by the Petitioner in civil suit No. 104 of 2008 and dispose of the same expeditiously. In order to avoid any confusion in future also, it is directed that the Civil Judge (Sr. Division) shall attend to all urgent matters falling within the jurisdiction of Civil Judge (Jr. Division), including the pending matters, as duly authorized by the High Court .

With these observations, the writ petition is disposed of, so also the pending application(s), if any.
