Ravinder Sood and Others vs State of Punjab and Another

Ritu Bahri, J.—Quashing of cross version dated 27.06.2004 (Annexure P-2) in FIR No. 153 dated 27.06.2004, under Sections 307, 511, 452, 323, 342, 427, 506, 148, 149 IPC, registered at Police Station City Hoshiarpur (Annexure P-1), is sought on the basis of compromise dated 23.01.2013 (Annexure P-5). An FIR No. 153 dated 27.06.2004 was registered under Sections 307, 511, 452, 323, 342, 427, 506, 148, 149 IPC, at Police Station City Hoshiarpur, on the basis of statement made by Amrit Sood-petitioner No. 2. Later on, a compromise was effected on 23.01.2013 and the said FIR was quashed vide order dated 03.07.2013 passed by this Court in Crl. Misc. No. M-8102 of 2013.

In the present petition, the petitioners have sought quashing of the cross-version dated 27.06.2004, which was registered against the petitioners on the statement of Vishal Sood-respondent No. 2, as the matter has been compromised vide compromise deed dated 23.01.2013 (Annexure P-5).

In compliance with the order dated 17.07.2013 passed by this Court, the parties got recorded their statements before the trial Court. Report from the Judicial Magistrate Ist Class, Hoshiarpur, has been received in this regard. As per report, Vishal Sood-respondent No. 2 made his statement on 18.11.2013 to the effect that he has arrived at a compromise with Ravinder Sood, Amit Sood, Vijay Inder Sood, Vineet Sood and Kunal-petitioners. Now he does not want to pursue the present case in view of the compromise and has no objection if the FIR is quashed. Statements of Kittu @ Kunal, Vineet Sood, Vijay Inder Sood and Amit Sood-petitioners were also recorded to the same effect. In view of separate statements of the parties, the court is satisfied that the compromise is valid and genuine one.

Consequently, in view of the status report and the judgment of the Hon''ble Supreme Court in the case of Madan Mohan Abbot Vs. State of Punjab, the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Others Vs. State of Punjab and Another, , this Court is of the view that no useful purpose would be served in prolonging the litigation, as the main FIR has already been quashed.

Accordingly, cross version dated 27.06.2004 in FIR No. 153 dated 27.06.2004, under Sections 307, 511, 452, 323, 342, 427, 506, 148, 149 IPC, registered at Police Station City Hoshiarpur, is quashed with all consequential proceedings arising therefrom qua the petitioners. The petition stands disposed of accordingly.
