By way of this petition, filed under Section 439 of Cr.P.C., the petitioner has prayed for his enlargement on bail, in case FIR No.17 of 2014, dated

19.01.2014, registered under Section 302 of the Indian Penal Code and Sections 27, 54 and 59 of the Arms Act, registered at Police Station Nalagarh,

District Solan, H.P.

When this case was taken up for consideration on 07.01.2021, the following order was passed:-

 “Learned Counsel for the petitioner has made a limited prayer in this case. He submits that the marriage of son of the petitioner is to be

solemnized from 13.01.2021 onwards and it will be in the interest of justice, in case, this Court permits the petitioner to join the marriage of his son by

releasing him on bail from 12th January, 2021 for a week.

Mr. Divya Sood, learned Deputy Advocate General submits that she may be granted some time to have instructions in the matter. List on 08.01.2021,

as prayed for.â€​

Today, learned Additional Advocate General, on instructions, submits that the petitioner be released on bail for a period of one week as from

12.01.2021, but by imposing stringent conditions upon him.

Accordingly, this petition is disposed of with, the direction that the petitioner shall be released on bail w.e.f. 12.01.2021, upto 18.01.2021. In other

words, the petitioner will have to surrender himself before the Jail Superintendent, Open Jail, Kanda, District Shimla, H.P., before 5.00 p.m., on

18.01.2021. This order is subject to the petitioner’s furnishing personal bond to the tune of Rs.50,000/- with one surety in the like amount, to the

satisfaction of the Jail Superintendent, Open Jail, Kanda, District Shimla, H.P. For the purpose of petitioner attending the marriage ceremony of his

son, he shall be accompanied by two constables and the petitioner to bear the expenses of said two constables as may be subsequently intimated by

the Jail Superintendent, Open Jail, Kanda, District Shimla, H.P., to the petitioner.
