Judgment
Anil Kshetarpal, J
On 26.9.2019, following order was passed by this Court:-"Petitioner prays for grant of pre-arrest bail in FIR No.322, dated 26.08.2016, registered under Sections 420/467/468/471 IPC, at Police Station Sadar, Sonipat.
Learned senior counsel appearing for the petitioner submits that the role attributed to the petitioner, as per FIR, is that he accompanied Deepak son of Prem Singh (first informant) to Bihar. Learned counsel for the petitioner further contends that the petitioner is only a Cab driver and not involved in the offence as such.
This Court has also heard learned counsel for the State.
Keeping in view the facts of the case, it is considered appropriate to direct the petitioner to join investigation.
In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C.
Adjourned to 25.11.2019."
Learned State counsel on instructions from ASI Vipinder Kumar has submitted that petitioner has joined investigation, cooperated and not required for further custodial interrogation.
In view of the above, order dated 26.9.2019 is hereby made absolute.
Petition stands allowed.
