Ms. Manjula R. Chauhan, learned advocate for the applicant, has filed a sick-note.
However, this application is filed praying for temporary bail on the ground of removal of Cataract from the left eye of his mother. For the said purpose, the applicant preferred an application before the trial Court on the very same ground, which came to be rejected vide order dated 09.02.2023, holding that he is also having an elder brother, who could look after the mother for the purpose of Cataract operation, and therefore, there is no need to release him on temporary bail on the said ground.
Though learned Judge has not mentioned the stage of trial, it is better that the learned Judge, while considering temporary bail application, also refers about the progress of the trial, if at all, it is ripe of evidence. However, I see no reason to entertain this application as his elder brother can look after his elder mother, and therefore, this application is rejected.
