Judgment
HEARD .
ABOVE noted I.A. No.2361/2015 has been filed on behalf of Respondents no.1 to 3 for setting aside ex parte order dated 27.2.2015 passed against them. Since, matter is at admission stage, respondents can join the proceedings. Accordingly application for setting aside ex parte order is allowed.
CONSUMER complaint filed by the appellant/complainant before the State Commission was dismissed in default due to the non -appearance of the appellant. The matter was at initial stage when the complaint was dismissed. In order to have decision on merits, in the interest of justice, the present appeal is allowed and impugned order passed by the State Commission, is set aside. The complaint filed by appellant before the State Commission stand restored subject to payment of Rs.20,000/ - (Rupees Twenty Thousand only) as cost.
APPELLANT is directed to deposit the above cost by way of demand draft in the name of "Consumer Legal Aid Account" within four weeks from today. In case, appellant fails to deposit the cost within the prescribed period, then present appeal shall stand dismissed automatically without any further orders.
THE State Commission shall make an endeavour to dispose of the complaint preferably within a period of one year, from the date of receipt of this order.
PARTIES are directed to appear before the State Commission on 18.5.2015 . Dasti to both parties.
