Heard learned counsel for the petitioners and learned Public
Prosecutor. Perused the material on record and the case diary.
This anticipatory bail application has been filed by the
petitioners apprehending their arrest in connection with F.I.R.
No.135/2016, Police Station Siwana, District Barmer for the
offences under Sections 143, 341, 323, 354 and 451 IPC.
The grievous injury caused to Durga Ram in this incident was
on his hand. Cross cases were registered between the parties.
The only non-bailable offence alleged against the petitioners is
under Section 452 IPC because the police did not find offence
under Section 354 IPC made out.
Thus, having regard to the entirety of facts and
circumstances of case and considering the arguments advanced at
the Bar, this Court is of the opinion that the petitioners deserve to
be granted anticipatory bail.
Resultantly, the instant bail application preferred on behalf of
the petitioners is allowed and it is directed that in the event of
arrest of petitioners (1) Ravi Das, (2) Mukesh, (3) Govind Ram,
(4) Mala Ram @ Maliya and (5) Ramesh Kumar in connection with
F.I.R. No.135/2016, Police Station Siwana, District Barmer, they
shall be released on bail; upon furnishing a personal bond in the
sum of Rs.50,000/- each along with two sureties of Rs.25,000/-
each to the satisfaction of the concerned Investigating
Officer/S.H.O. on the following conditions :-
(i). that the petitioners shall make themselves available for interrogation by a police officer as and when required;
(ii). that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and
(iii). that the petitioners shall not leave India without previous permission of the court.
