Instant writ petition has been filed under Article 226 of the Constitution of India for issuance of certificate for release of the remaining 1.42 acres of land out of 4.42 acre which was acquired for the expansion and mining of Kedla Underground Project. Release has been sought for so that it can be clubbed together with other land for seeking employment.
In this regard, representations had been filed by the petitioners on 20.12.2023 and 20.07.2024 before the respondent nos.5 and 6.
As per the case of the Petitioners, 4.42 acre of land recorded in the name of Ramchandra Sao and Anandi Sao of Mouza Hurdag was acquired. In terms of the Rehabilitation and Resettlement Policy of Coal India Ltd., 2012, employment was offered to eight persons from the land holder family. Out of eight, only seven employment were given as there was no person eligible at that time for the employment. Therefore, employment to the 8th person namely Satyendra Kumar Singh could not been given with respect to 1.42 acre of land.
In order to club this land under the provisions of B(3) of Rehabilitation and Resettlement Policy of Coal India Ltd., 2012, representations were filed before the competent authority for releasing the same, which have not been disposed of till date.
Under the circumstance, respondent nos.6 and 7 are directed to dispose of the representations dated 20.12.2023 and 20.07.2024 filed by these petitioners within four weeks of communication of this order.
Writ Petition is disposed of. Interlocutory Application, if any, is disposed of.
