K. Hema, J.—This petition is for bail.

The alleged offence is u/s 379 r/w 34 of Indian Penal Code. According to prosecution, de facto complainant''s wife is running a textile shop. Petitioners (A1 to A6) came to the shop and selected four churidar sets. They left the shop stating that they will come back and pay the money. But, after Petitioners left the shop, it was found that 29 churidar sets were missing from the shop. Petitioners committed theft of 29 churidar sets. The incident happened on 13/06/2010 at about 1 p.m.

Petitioners were arrested on 13/06/2010 and they are in custody for the past 33 days. This petition is not opposed. On hearing both sides, I am satisfied that bail can be granted to Petitioners on conditions. Hence, the following order is passed:

Petitioners shall be released on bail on their executing a bond for Rs. 50,000/- (Rupees fifty thousand only) each with two solvent sureties each for the like sum to the satisfaction of the court concerned, on the following conditions:

(i) Petitioners shall report before the Investigating Officer on every alternate day between 10 a.m. and 1 p.m. and co- operate with investigation.

(ii) Petitioners shall not leave the limits of the police station within which the crime is registered, except for compliance of condition No. 1.

(iii) Petitioners shall not influence or intimidate any witness or tamper with the evidence.

(iv) In case, Petitioners are involved in any similar offence, bail is liable to be cancelled.

This petition is allowed.
