Judgment
Kanwaljit Singh Ahluwalia, J.—The present petition has been filed u/s 438 Cr.P.C. seeking pre-arrest bail to the petitioner in case FIR No. 37 dated 5.3.2006, registered at Police Station City, Kapurthala, under Sections 406 & 420 IPC.
In the present case, complainant was duped of huge funds on pretext of sending abroad. The solitary argument raised by Counsel for the Petitioner before me is that in the FIR name of the Petitioner has been given as Palo daughter of Sohan Singh, whereas her real name is Rashpal Kaur daughter of Joginder Singh.
This fact has been dealt with in the impugned order passed by the Additional Sessions Judge, Kapurthala. It was observed that the complainant and witnesses were present in the Court making submissions that Rashpal Kaur daughter of Joginder Singh was the actual person who disclosed her name as Palo daughter of Sohan Singh. Thus, identity of the petitioner is required to be determined during custodial interrogation.
No grounds is made out to grant pre-arrest bail to the petitioner. Hence, the present petition is dismissed.
