Heard Sri Anurag Verma, learned counsel for the petitioner, learned Chief Standing Counsel has accepted notice on behalf of opposite parties no.1 to 3 and Sri D.K. Arora, has accepted notice on behalf of opposite party no.4.

The petitioner has alleged that he has worked for three consecutive years as Lecturer in the Department of Zoology in Brahmanand College, Kanpur.

Learned counsel for the petitioner submits that the petitioner is eligible for absorption on the post of Lecturer in the Department of Zoology as he possessed the requisite qualification for absorption as enumerated in Section 31E of the Uttar Pradesh Higher Education Services Commission (Third Amendment) Act, 2006.

In view of the aforesaid facts, we dispose of the writ petition with a direction to opposite party no.1 to consider and decide the case of the petitioner for absorption in accordance with the provisions of Section 31E of the Uttar Pradesh Higher Education Services Commission (Third Amendment) Act, 2006 within two months from the date a certified copy of this order is produced before him.
