Application under Section 528 of Bharatiya Nagarik Suraksha Sanhita (B.N.S.S.), 2023 has been moved for placing on record orders of this Court vide which FIRs against the petitioner have been quashed or cancellation reports have been accepted (Annexures P-3 to P-11).

Petitioner seeks quashing of FIR No.104 dated 13.10.2018 under Sections 66-C, 66-D of the Information and Technology Act, 2000 and Section 469 IPC, Police Station Phase-VIII, Mohali and all subsequent proceedings arising therefrom, on the basis of compromise dated 04.11.2025.
On 21.11.2025, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements with regard to compromise dated 04.11.2025.
In compliance of the aforesaid order, parties appeared before learned Judicial Magistrate Ist Class, SAS Nagar on 15.12.2025. Statements of Investigating Officers DSP Gabbar Singh and SP Rupinderdeep Kaur were recorded on 02.12.2025. Learned Judicial Magistrate Ist Class, SAS Nagar has submitted his report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. Point-wise report as under has been submitted:
“Regarding point (1) it is submitted that there is only one accused namely Rashmi Negi involved in the present FIR.
Regarding point (2) it is submitted that as per the statement of IO, accused has never being declared proclaimed offender.
Regarding point (3), it is submitted that on the basis of statements of the parties, the compromise between the parties is genuine, voluntarily and without any coercion or undue influence.
Regarding point (4), it is submitted that as per the statement of IO, the accused is also involved in some other FIRs as detailed in her statement.
Regarding point (5), it is submitted that as per the statement of IO, there is only one complainant namely Ashwinder Singh Mongia and one victim namely Akashdeep Singh Mongia in the present FIR.
It is further submitted that the statement of IO/DSP Gabbar Singh No.76/RR and another IO/SP Rupinderdeep Kaur have also been recorded with regard to Point 1, 2, 4 and 5. It is further submitted that as per the statements of the complainant, victim and accused, the compromise appears to be genuine, voluntarily and without any coercion or undue influence.”
Learned State counsel and learned counsel for respondents No.2 and 3 have not raised any dispute regarding the factum of compromise.
The case emanates out of a matrimonial discord between the petitioner and respondent No.2. The FIR was lodged by respondent No.3 alleging that petitioner had uploaded personal moments of the family online without the knowledge of the complainant to extort money. As per details furnished by petitioner, all FIRs against her have been quashed and nothing is pending, copies of orders of the Competent Courts have also been placed on record. Since the matter has been amicably resolved, continuation of the criminal proceedings would be an exercise in futility.
Following principles of law laid down by the Full Bench Judgment of this Court in “Kulwinder Singh and others Vs. State of Punjab and another” 2007(3) RCR (Criminal) 1052 and Hon’ble Supreme Court in “Gian Singh Versus State of Punjab and others” (2012) 10 SCC 303, the petition is allowed.
FIR No.104 dated 13.10.2018 under Sections 66-C, 66-D of the Information and Technology Act, 2000 and Section 469 IPC, Police Station Phase-VIII, Mohali and all consequential proceedings arising therefrom, are quashed qua the petitioner, on the basis of compromise dated 04.11.2025.
Pending applications, if any, stand disposed of.
