Judgment
Ravindra Maithani, J
Applicant Rashid, is in judicial custody in NCB Crime No. III NCB/DDN/Seize /05/2022, under Sections 8 /22C/29 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station NCB Dehradun, He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
According to the prosecution case, on 26.09.2022 narcotic substance in commercial quantity was recovered from co-accused Shiv Kumar, who revealed that he would sell it at the behest of co-accused Anees and the room was made him available by co-accused Siraj Ahmed.
Subsequently, it is the case of the NCB that, in fact, it applicant Rashid, who would supply the narcotic substances to the Siraj Ahmed. For that purpose, Siraj Ahmed, deposited Rs.3,45,113/- in the account of the applicant. It is Siraj Ahmed, who also pays small amounts to Shiv Kumar, who was the carrier of the narcotic substances. Leaned counsel for the NCB would also submit that the applicant has criminal history also, though he admits that he is not a convict.
Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
