Learned counsel for the petitioner submits that though the petitioners are only witnesses to an agreement of sale between the complainant, Basir, and another co-accused, Jumme Khan, and therefore they cannot be held liable for any alleged forgery of the said agreement, learned counsel for the complainant submits that as a matter of fact, the complainant was earlier a resident of the same village as the petitioners are resident of, i.e. Village Kot, Tehsil Bahin, District Palwal, and that he shifted to District Alwar (Rajasthan) only 10-15 years ago.

Learned State counsel on instructions from the police official who is present in Court to assist him, submits that the first petitioner was in fact the Nambardar of the village, and both the petitioners are about 60 years old, and therefore it is not possible that they did not know the complainant, who had shifted out of Village Kot only about 15 years ago.

He has further produced in Court today a copy of a forensic report, to submit that the signatures of the complainant (Basir), on the agreement of sale, are not found (as per the forensic science laboratory), to be matching with his admitted signatures.

That being so, without making any comment on the actual merits of the case for or against the petitioners, this petition is dismissed.
