This first application under Section 439 of Cr.P.C. has been filed for grant of bail.
The applicant has been arrested on 18.10.2022 in connection with Crime No.487/2022 registered at Police Station Padav, District Gwalior for offence under Sections 3, 4, 5, 7 of the Immoral Traffic (Prevention) Act, 1956 and Section 370-A of IPC.
It is the case of the prosecution that the applicant was working as a Supervisor in the hotel and had guided the decoy customer to room No.215 where five girls were staying and another girl was found along with one boy in room No.202.
Upon search, not only the money paid by decoy customer to the Manager/person sitting on the counter was seized but objectionable used and unused items were seized. Further, one girl with a boy was found in objectionable condition in room No.202 and with the help of lady police personnel, the said girl was permitted to wear the clothes.
Under Section 176 of IPC the applicant was under obligation to give information to the public servant and if that was not done, then it can be presumed that the applicant was also sharing common intention. Under these circumstances, no case is made out for grant of bail.
The application fails and is hereby dismissed.
