The writ petition has been filed with an innocuous prayer by the mother of a 41-years old man, alleging that the petitioner’s son has been missing

for some time. The petitioner has two addresses, one as given in the cause title, being 222/3, Belilious Road, Howrah-711101 and the other at 55/1/2

Abinash Chandra Banerjee Lane, Kolkata.

Learned counsel for the petitioner submits that the latter address falls within the jurisdiction of the Beliaghata Police Station and the petitioner

approached the said police station and found that a missing diary has already been lodged regarding the absence of the son of the petitioner with the

said police station by some unknown person. Accordingly, the petitioner sought for getting a copy of such missing diary, but the same was not given to

her.

On query from court, learned counsel for the petitioner informs the court that the petitioner herself has also lodged a missing diary at Howrah.

However, to get a proper and complete picture of the matter, it is necessary for the petitioner to know the whereabouts of the person who lodged the

missing diary at the Beliaghata Police Station.

Learned counsel appearing for the respondents hands over a copy of the said missing diary, lodged with the Beliaghata Police Station, to his counter

part appearing for the petitioner and submits that the Beliaghata Police Station already attempted to serve the said copy on the petitioner but could not

do so since the petitioner left with the said police station her address at Abinash Chandra Banerjee Lane and not the Howrah address. However, since

the copy has already been served on learned counsel for the petitioner in court here and now, the cause of action of the present writ petition has spent

its force.

Accordingly, W.P. No.283(W) of 2020 is disposed of with the aforesaid observations.

There will be no order as to costs.
