Judgment

The review petitioner is the respondent in W.P(C)No.44299/2023, which was disposed of by this Court, as per judgment dated 29.12.2023. Review is sought for on the premise that, the review petitioner was not heard while the said judgment was rendered.
The review was considered on 04.03.2024, as also, on 30.05.2024. This court notice that, the only interdiction as against the review petitioner/Bank was not to evict the petitioner from the premises, otherwise than in accordance with law. Now, it is the case of the review petitioner that, a notice has been issued, calling upon the petitioner in the writ petition to remit the dues and that there was no compliance of the same, de hors the expiry of the period stipulated therein. According to the learned counsel for the review petitioner, the review petitioner is entitled in law to proceed against the writ petitioner for recovery of dues as per of law.
Learned counsel for the writ petitioner, who is the respondent in the review petition, would submit that, the notice claimed to have been issued is not one in accordance with law. If the writ petitioner has a grievance in respect of the notice issued, it is for him to challenge the same, in accordance with law.
In the above referred facts and circumstances, this Review Petition is closed, leaving open the rights of both parties to pursue their respective remedies in accordance with law.
