At the outset, learned counsel for the petitioner fairly submits that the transfer deed, which was sought to be cancelled by invoking Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, was executed pursuant to an order passed by the Lok Adalat. Consequently, the application filed before the Maintenance Tribunal was misconceived, as the appropriate remedy for redressal of the petitioner’s grievance lies elsewhere. He, therefore, seeks permission to withdraw the original application filed before the Maintenance Tribunal, with liberty to pursue appropriate statutory remedies.
The request of learned counsel for the petitioner is not opposed by learned State counsel or by learned counsel for the respondent No.4, being founded on sound legal submissions.
Consequently, the petitioner is permitted to withdraw the original application filed before the Maintenance Tribunal, with liberty (supra).
Disposed of accordingly.
