Ranjit Buildcon Limited vs Ahmedabad Urban Development Authority

By way of this petition, the petitioner has prayed for the following reliefs:

“21(A) Your Lordships may be pleased to issue a writ of certiorari or any other writ, order or direction declaring the impugned letter dated 05.08.2022 from the respondent Ahmedabad Urban Development Authority communicating its decision to terminate the contract with the petitioner and resulting floating of fresh tender no.20/2022- 23 (Dated 02.08.2022) for the balance work as bad in law being contrary to the principles of natural justice and thus violative of Article 14 of the Constitution of India and quashing and setting aside the same;

(B) Your Lordships may be pleased to issue a writ of certiorari or any other appropriate writ, order or direction declaring the action on the part of respondent Ahmedabad Urban Development Authority in not releasing the outstanding dues of the petitioner amounting to Rs.08.40 crore towards the works already executed as being arbitrary, bad in law and thus violative of Article 14 of the Constitution of India;

(C) Your Lordships may be pleased to issue a writ of mandamus or any other appropriate writ, order or direction commanding the respondent Ahmedabad Urban Development Authority to withdraw the Tender Notice no.20/2022-23 (Dated 02.08.2022) for balance work and continue the contract with the petitioner in terms of work order given to it on accepting its tender, vide work order dated 05.03.2019;

(D) Your Lordships may be pleased to issue a writ of mandamus or any other appropriate writ, order or direction commanding the respondent authorities to release the payments due to the petitioner in respect of the works already executed by it amounting to Rs.08.40 crore;

(E) Pending admission and final hearing of the present petition, Your Lordships may be pleased to stay/suspend the operation and implementation of the order of termination of contract communicated in letter dated 05.08.2022 and tender notice no. 20/2022-23 (Dated 02.08.2022) issued for balance work; and

(F) Your Lordships may be pleased to pas any other and/or further order, as deemed fit, in the interest of justice.”

During the pendency of the petition, an additional affidavit dated 18.11.2022 has been filed by the petitioner. Along with the said affidavit, a communication dated 21.10.2022 issued by Ahmedabad Urban Development Authority is placed on record. By the said letter, the present petition is permitted to continue its work as per the terms and conditions of the contract awarded to the petitioner.

In view of the above, learned advocate for the petitioner does not press this petition. Petition is dismissed as not pressed. Notice is discharged.
