After hearing at some length, and on perusal of the impugned order dated 07.03.2024, passed by the Chief Executive Member, Garo Hills Autonomous District Council Tura, it is noted that the genesis of the matter pertains to a Mouzadar report dated 20.11.1926, with regard to the erection of the boundary dhips/marks between two Akhings namely; Skagre Akhing and Jelbongpara Akhing. It is further noted that the Deputy Commissioner after the said demarcation had allowed time to appeal to any aggrieved parties, but as none was forthcoming, later vide order dated 21.03.1930, the Deputy Commissioner one N.E. Perry approved the map inclusive of the areas marked ‘A’ of the sketch map, to be of Jelbongpara Akhing.
The dispute sought to be raised by the present petitioner is that the said plot ‘A’ was always part of Skagre Akhing, and the same had been wrongly demarcated in the report dated 20.11.1926.
Though Mr. P.T. Sangma, learned counsel for the petitioner has prayed that he may be allowed to withdraw the instant writ application with liberty to file afresh, in the considered view of the Court, the same would serve no purpose, as what is being sought to be done by the petitioner herein, is to revive a dispute which was closed as far back as in 1930.
As such, for the reasons aforementioned, the prayer for withdrawal is rejected, and the writ petition stands dismissed.
